Ebony Systems develops and distributes digital audio tools, including VST/AU/AAX plugins, sound design utilities, presets, expansions, and other digital products for music producers and sound designers.

By accessing our Site or downloading/using our plugins, you agree to these Terms and our Privacy Policy.

Eligibility / Age

By using the Service, you confirm that you are at least 16 years old.

If you are under 16, you must have permission from a parent or legal guardian.

Software Licenses & Accounts

License Grant

When you purchase or download an Ebony Systems plugin or digital product, you are granted a non-exclusive, non-transferable, revocable license to install and use the software for personal or commercial music/audio production.

You do not own the software; you are licensing its use.

License Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or attempt to extract source code
• Resell, share, or distribute license keys or installers
• Upload or post the plugin or presets to piracy sites
• Circumvent copy protection or licensing systems
• Use the software in violation of applicable laws

Violating these restrictions may result in license termination without refund. We are not required to provide updates indefinitely, but will aim to maintain stable functionality for supported operating systems and DAWs.

Account Requirements

For installs, downloads, or product updates:

• You must provide accurate registration information
• You are responsible for safeguarding your account and license key(s)
• Unauthorized account sharing may result in suspension

Payments

• All prices are listed in USD, unless stated otherwise.
• Payments are securely processed through third-party providers (e.g., Stripe, Paddle, Shopify).
• By submitting payment information, you authorize Ebony Systems to charge your selected payment method for purchases or renewals (if applicable).

Refund & Cancellation Policy

Because Ebony Systems sells non-returnable digital software, our refund policy reflects the nature of downloadable products.

a. Plugins, Software, Presets, Digital Downloads

All software sales are final once the product has been downloaded, activated, or accessed.

We may consider refunds only in the following exceptions:

• A proven duplicate purchase
• A verified technical issue that cannot be resolved by our support team Any request must be submitted within 7 days of purchase.

b. Subscription-Based Products (if applicable)

Subscriptions may be canceled at any time through your account dashboard.

• Cancellation applies to the next billing cycle
• Partial-period refunds are not provided
• Access remains active until the end of the paid period

c. Chargebacks

Initiating a chargeback without first contacting support may result in:

• Immediate license suspension
• Revocation of access to future updates
• Additional verification requirements for future purchases

Software Updates

We may provide updates, bug fixes, improvements, or new features.

We are not required to provide updates indefinitely, but will aim to maintain stable functionality for supported operating systems and DAWs.

Intellectual Property

All Ebony Systems software, code, names, imagery, branding, presets, DSP algorithms, and documentation are owned by Ebony Systems or its licensors.

You may not copy, modify, distribute, or exploit any content without written permission.

User Content

If you submit feedback, suggestions, presets, or beta reports, you grant Ebony Systems a non-exclusive, royalty-free license to use that content to improve or promote the Service.

You understand that:

• Feedback may be used without obligation to compensate you
• Submitted content must not infringe the rights of others

Limitation of Liability

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, Ebony Systems is not liable for:

• Loss of data, projects, or work sessions
• System incompatibilities
• Indirect, incidental, or consequential damages
• DAW or OS issues resulting from third-party updates You are responsible for backing up your projects and presets.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflicts of law principles.

Any disputes will be handled exclusively in California courts.

Changes to Terms

We may update these Terms at any time. The updated version will always be posted on this page.

Your continued use of the Site or software following any changes constitutes acceptance of the revised Terms.
